Terms and Conditions

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the site www.khaolakdiscoveries.com website (the “Service”) operated by [Khao Lak Discoveries] (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Bookings

1. Please note that all bookings are considered tentative until a 50% deposit is received.
2. After making a booking we will get back to you to check availability. Then we will request you to pay 50% deposit. Deposit payments can be done by bank transfer to our bank accounts in Germany or Thailand, via PayPal or cash at our office.
3. The balance is due on the day of the tour and will be collected cash in Thai Baht by your tour guide when we pick you up in the morning from your Khao Lak hotel.
4. All payments are non-refundable, unless cancellation is received latest by 4 pm the day before the tour date, or a signed medical statement must be provided. We have no liability for any other costs in case of cancellation. In case Khao Lak Discoveries has to cancel the trip, no administration fee is charged and we will return your deposit in full.

1. WEATHER and OTHER CONDITIONS

Be aware that there might be changes to our tour program due to weather conditions, force majeure (like natural disasters, political unrest, civil war and other hostilities) or other circumstances! Sometimes we even need to move the tour to another date or, in rare cases, to cancel it. Thank you for your understanding; this is purely for your safety.

2. CANCELLATIONS

In order to receive a full refund, cancellations must be done latest by 4 pm the day before the tour date, or a signed medical statement must be provided. Modifications or cancellations resulting from circumstances outside of the Company’s control (force majeure like natural disasters, political unrest, civil war or other hostilities) are not refundable.

3. PERSONAL SAFETY

All guests should be aware that every tour has potential dangers in the activities they are participating in, and therefore are responsible for their own personal safety on our tours. Injuries or discomfort as a result of any unfitness or health conditions are the sole responsibility of the participant. All instructions and directions of our tour guides must be followed at all times!

4. CUSTOMER LIABILITY

Guests can be held liable for personal and material damage that happens due to negligence on their part.

5. PERSONAL BELONGINGS

Khao Lak Discoveries cannot be held responsible for the damage or loss of any personal belongings.

6. SPEEDBOAT TOURS

Pregnant women and children younger than 1 years old cannot participate in any of the speedboat tours. To prevent accidents, all guests should sit in the rear part of the boat, sitting in the open front part is on everybody’s own risk.

7. PRICES

Our prices apply only for pick-ups in the Khao Lak area. Children prices apply to children between 5-12 years, infants aged 0-4 years are free of charge and children from the age of 13 years pay full price.

8. PAYMENTS

For all payments via credit card (VISA or Master Card) the banks are charging a 3 % fee that has to be paid by the customer. The customer is also responsible for the payments of other transaction fees (like exchange fees). In cases of refund, the exchange rate to be used will be the one at the processing day. Any fees from the refund, and/or bank transaction fees will be deducted from the refund, and paid for by the customer, not the Company.

Khao Lak Discoveries has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services.

You further acknowledge and agree that Khao Lak Discoveries shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchant-ability, fitness for a particular purpose, non-infringement or course of performance.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.

If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our discretion.

By continuing to access or use our Service after those revisions become effective. You agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
